Phuket air now saying no seat available

I was originally booked and confirmed on 20th march on phuket air.

 

My travel agent rang me this morning and I was told that phuket air have advised them that no seats are available on that day.

 

Does anyone know how I stand as the seat was booked as part of a package deal

and a deposit was paid over two months ago.

Just curious, don't you think your travel agent is the one who should have the answer to your question?

 

If you paid by credit card. Your covered because they didn't deliver on what they promised. Call and then write a letter to your cc.

I'm not an expert on the law but I would say that you should be allowed to fly out on another date with Phuket Air or if that is not convenient you are entitled to a FULL refund.

 

Of course, if you get a full refund you will then have to find another package and it could be that this will cost you more than £200 more than the original cost. If you can't get an answer from your travel agent, (who might be trying to dodge the issue B) ) it might be worth putting the question to your local Citizens Advice Bureau.

As far as I know, the Travel Agent's regulation board ABTA (UK) state that a change of more than 12 hours in your flight is "significant" and you should be entitled to a full return of your cash in these circumstances.

 

I don't know where yopu are flying from, but if it's from the UK, Phuket Airlines have a flight from Gatwick on 22 March. They have altered schedules a lot recently.

 

I recently found that the mention of "naming and shaming" both Phuket Airlines and my travel Agency on a web board of 6,000 members dedicated to travel to Thailand resulted in an immediate change in their policies and I was changed to flights outside Phuket's "discount period" at the same price.

 

I await the end result though.

A combined transport and accommodation booking comes under the Package Tour Regulations 1992, part of EU-wide legislation.

 

In the case of "significant change", you are entitled to, either:

 

Accept alternative arrangements

 

Accept alternative arranagements and pay/receive the difference in cost.

 

Cancel your booking and receive a full refund of all monies paid.

 

The choice is yours, not the agents. BTW it is the agent who is liable, not the airline. The agent should have appropriate insurance in place to cover such eventualities.

My travel agent rang this morning and after I declined their offer of flying with a different carrier for £200 extra [ it was Austrian airlines ]

they now advise that I can now fly on original dates with Phuket air.

 

I now await the tickets with baited breath.
