That's good news and bad news. If they are only available through a company, that means they are 49 percent sold. The bad news is that anyone who buys a property in Thailand through a company needs a few lessons in reality and economics.

Many a house is lived in under this guise. Doing it for a condo is taken negatively because it is unnecessary, you can own a condo outright.

These legal 'articles' are often sponsored by those selling condos!

Why would anyone want to have Thai company to control property? Are they aware that the company is bogus and that in order to keep the company they will have to pay an accountant and pay taxes on something that will never make any money?

 

I like to sleep nights and wouldn't sleep well knowing that any day some nationalistic politician may get a hard on for some reason or another and pull the plug on these bogus companies. Because these companies pay taxes and benefit accountants and lawyers they continue to exist and may never be prosecuted. That said, I certainly wouldn't be willing to take the chance.

 

Regardless of what the shyster lawyers tell you, companies set up to control property are NOT legal.

It is one of the 3 choices I suppose, along with usufruct and Thai wife/GF's name and 30 year lease. They all hold a risk and that very limitation should make people consider renting.

 

Quite a few 'wives' get a hard on and leave a man homeless!

A 30 year lease is pretty solid if you get it while you are still single and from a stranger. Getting the lease from your wife or after you are married makes it marital property. I seriously considered that option but knew that I would eventually get married and would want my wife to have something after I cash in my chips.

 

The usufruct from your wife is worthless if she decides to cancel it. You then have the option of moving out or killing her before she cancels it which would make the usufruct more valuable. On the other hand a lifetime contract is not so good either. It's never a good idea to be worth more dead than alive. Her relatives may decide that the property is much more valuable than your life and a hit-man is not that expensive.

 

Buy a condo in your own name or trust your wife and put the house in her name. I have bought property in my wife's name and after about eight years together, I don't expect her to throw me out, but, I am realistic and know it could happen. I still have the condo in my name that I bought before we got married. My pickup truck is also in my name. If worse should come to worse, I still have a roof over my head, transportation and I won't miss any meals.

 

Some guys will tell you that they have rights and will take it to court where they will get half. What they don't know is that their scheming lawyer will cost them a bundle and even if they win in court, they are still likely to get nothing. That court is a civil court and it has no power to enforce the decision.

The article was written by a lawyer who pointed out that having a Thai company then using the sole asset as your house means you've earned a benefit from the company which of course you didn't pay tax on and they go after that. The article said that there is no need to do this if you want a condo.

 

Since in both cases a condo is being sold your point about legal articles makes no sense at all.

In the particular case of the one you read perhaps, but since I used a plural that wasn't what I was referring specifically to was it.
