Settlement notice for Credit and Debit card users

Any person who held a Visa-, MasterCard- or Diners Club-branded credit, charge or debit/ATM card issued in the United States as of November 8, 2006 is a member of the Settlement Injunctive Class. Those persons who made a foreign transaction using a Visa-, MasterCard-, or Diners Club- branded credit, charge or debit/ATM card between February 1, 1996 and November 8, 2006 are members of the Settlement Damages Class.

There are three different ways they are settling.

 

Option 1. Get a straight $25 refund.

Option 2. Get a 1% refund of transactions predicted based on amount of travel.

Option 3. Show records and get up to a 3% refund.

 

I suspect this only applies to Americans but may not be the case.

 

I would think that some of the Retires that live off of their cards will get a big refund.

 

 

 

Now if this information actually helps anyone, you owe me a drink.

I have already filed choosing option 2

I went back thru my passports and counted the days from February 1,1996 to November 8,2006 a total of 220 days out of the country for me.

I filed online on December 6, 2007.

I'll post what amount and length of time it took to reach me.

How will the lawyers be paid?

 

The lawyers for the class members will request 27.5% or the estimated $313,000,000 expected to remain in the settlement fund after deducting costs for administering the settlement and notice, plus interest, for attorneys' fees for investigating the facts, litigating and resolving the case. They will also request reimbursement of their expenses, not to exceed $5,000,000, to be paid from the settlement fund.

 

 

 

So by my calculations: $86,075,000 + interest + up to $5,000,000 for expenses.

Well, I just got my letter, not sure how I'm gonna do it yet but the easy way out is $25.00. That means I would be paying the dickhead's about 7 bucks :D That will get them a hand job from one very needy crack ho with dirty hands :D

All the options are dependent on how many people apply for how much.

The number of eligibles is close to 30 Million. After the lawyers get their cut the remainder is about 9 dollars US for each of the 30 million. Sure hope that most of the 30 million decide not to apply, that would mean more for those who do. You may get up to $25 using option one; the other two options are also dependent on how many apply for how much.

I got the form in the mail when I returned from LOS on the 18th. I added up my days and it total 790. I wish they would have gone to the end of this year then I could have added another 240. I'm too lazy to do option 3 even though I have my statements back to the beginning on 2001.

This from the settlement web site:

"Please be advised that any claims postmarked or faxed after May 30, 2008 will be considered late."

 

I did file on time using option 2 and a large number of days (over 200) I don't recall exact number. I am still waiting.

 

Also from settlement site:

 

"The Court has entered a Memorandum and Order, dated October 22, 2009, granting final approval of the settlement. Please visit the "Documents" section on this site to obtain a copy of this Memorandum and Order. The issuance of refund checks for valid, timely claims will not commence until after the entry of a final judgment concerning the final approval of the settlement, any potential appeals are resolved, and the Settlement Administrator has validated the claims."

From the FAQ section of the website.

 

"Please note that any claim form post-marked after May 30, 2008 will be deemed untimely. Also note that due to the large number of claims that were submitted prior to the May 30, 2008 deadline, it is anticipated that refund amounts will be adjusted (or “pro-rated”). The information provided in the FAQs about the claim submission procedure is retained for reference."
