Fraud?? Visa fraud??

 

 

You must remember that coming to the US with the sole intention of getting married in the US and filing for adjustment of status is deemed to be visa fraud, and US immigration officers do not take kindly to anyone they feel has committed visa fraud.

This I presume is someones interpretation of of US Law???

 

Without researching US laws and immigration rule I would assume that this statement would be more correct "You must remember that coming to the US with the sole intention of getting married in the US and filing for adjustment of status is deemed to be visa fraud, and US immigration officers do not take kindly to anyone they feel has committed visa fraud."

 

If the word "sole" is used before intention one could easily say they were going to Disney Land too :whistling:

Thanks guys. I got it now. Sorry I was just a little over excited that maybe we could get this visa done. Will keep trying.

 

You can still do it. You really just need three things.

1. Show evidence that she has strong reasons to return to Thailand.

2. Her reasons for going to the US are within the rules.

3. She has the money to support herself while in the country, and return to Thailand.

 

If your niece has been turned down, you can bet it was for one of those three reasons. You have not given any details, age, occupation, reason for traveling and such. Most of the time when I hear a story like yours, as the story is told, I can spot why the lady has been turned down. Most of those I have heard of, there was someone in the US that was going to pick up the tab for travel, feed, house, and entertain the lady. While that sounds good to us, let's look at it from immigrations view, and experience. The girl comes to the US and stays with you. A week later you find out that she has been sleeping with your son, and you tell her to get out. Now there is a foreigner in the country with no means of support, and no way home. It doesn't look good at that point. They will expect the girl to do something illegal to support herself, and she won't go home when her visa runs out. Either she can't afford to, or decides that she doesn't want to.

 

Try again, but make sure you have those three things covered. Read the rules over and over again, make sure that she reads them. You may have to have your wife translate them for the girl, but she needs to know what she can't do.

I did my wifes visa application to the UK and the USA online and the UK one took 14 days - 6 months multi entry and the USA took 20 days - 10 year multi entry. Do it all yourself, follow what it says online and its easy. It does not have to cost so much paying the "agents" I have to say, the USA embassey was much easier to deal with to the UK embassey, but overall - if you have all of the required documents - it is easy enough

Well I did the UK one myself, it was tiresome but not too difficult, being computer savvy and having your own copier/ printer helps. Although you actually don't deal with the embassy do you?

I had forgot about that. I bought a printer just to do the application. Got a cheap one, but well worth the money as I needed it. It was great for doing pictures, because I could put 4 per page, and label them. You are right, we don't deal with the embassy, other than doing all the paperwork, and getting everything together. She goes in alone.

Well more so than that.... having to wait outside while she is in there alone screwing up all your efforts :D.

The UK one is an agency that you deal with, VFS Global.

I dealt with the British embassy but that was in Beijing. I went in with her for her interview and the immigration official told me to shut up as I was talking to my then wife. She was used to talking down to the Chinese I feel, as I could see the look on her face when she realized what she said.I gave her a mouthful.Got the visa anyway

It was easy enough, i filled it all out and she went for the 3 question interview, 10 days alter the visa was issued. I thought dealing with the American visa application was easier and faster. I was shocked that for her first US visa, she was given a 10 year multi entry

lovedog's wife got a 10 year multi entry as well. You had a big advantage, in that you had already taken her to the UK as a visitor. That's got to count for a lot.

 

Just to summarize, visitor visas for Thais are not impossible to get...if the Thai is in a relationship with an expat living in Thailand.

 

I've not heard of any cases where one was obtained that didn't fit that profile, so that might be where the "common knowledge" that visitor visas are unobtainable comes from.

Yes, we had been to the UK first for a week and then back to Ghana for only a week, the whole interview at the USA Embassey seemed to focus on what we were doing while in the USA and where we stayed. When the lady saw we were married, she just told my wife to enjoy the shopping in Houston
