Blacklist for Overstay... Soon ?

Here is what has been announced today on ThaiVisa, of what *could* be rules soon.

* In the case that alien surrenders themselves:

  • Overstay more than 90 days > Forbidden from re-entering the kingdom for 1 year.
  • Overstay more than 1 year > Forbidden from re-entering the kingdom for 3 years.
  • Overstay more than 3 years > Forbidden from re-entering the kingdom for 5 years.
  • Overstay more than 5 years > Forbidden from re-entering the kingdom for 10 years.
  • Overstay more than 10 years > Forbidden from re-entering the kingdom for life.
* In the case that the alien is being apprehended:
  • Overstay for less than 1 year > Forbidden from re-entering the kingdom for 5 years.
  • Overstay for more than 1 year > Forbidden from re-entering the kingdom for 10 years

In fairness I cant think of a good reason why I should be happy that anyone is an overstayer in my home country. They sponge and work for chicken shit under the counter money. If I dont like it where I live I can hardly justify it elsewhere.

Unfortunately the fact of the matter is that if someone can't afford to stay legally in Thailand, they shouldn't be here to start with. Thailand is a third world country and unlike the US, they are not going to treat destitute overstaying farangs with kid gloves.

And remember, the biggest part of Thailand's immigration problem does not involve westerners.

Yesterday I did my 90 day report. I had to sign a paper called acknowledgment of penalties of overstay. It reads the same as posted above. Some say that it is law already and others say that it will not be law until sometime in August. I would hope that for the sake of some unfortunate overstay victims that there will be a couple weeks of amnesty to straighten out their visas. I know of one person who lost millions of baht through his naive trust of Thai people. If he is forced to leave Thailand and not be able to return for five years, there is no doubt in my mind that he will commit suicide if he has time to do it.

 

I have no sympathy for people who come here without the means to support themselves and to be able to stay legally. HOWEVER there are some circumstances that would warrant special treatment.

Seems odd that you have to sign this document which outlines the punishments for not doing what you are at immigration to do!

I don't know why you need to even sign a document anyhow, unless it is seen as not a regulation or law, but a contract/agreement you enter into based on getting your extension of stay.

Hi,

 

I have some sympathy for some people who overstay. LOS is a beguiling land to us falang and some of us lose control. I suppose most of them jump rather than face the reality of trying to make a living in an unpleasant homeland.

Overstay Ban Rules now official on the Immigration website :

Edit: Looks like they need a 60 days period to apply such rule => mid-September ?

 

If you know people in overstay who will be over 90 days overstay in September,

you can recommend them strongly to regularize their situation

by exiting Thailand by air and paying the 20'000 baht fine.

At least it will "clean" their actual overstay and the risk of being banned...

Well, it is a news story rather than the rule itself, but I wouldn't be overstaying.

I got flagged leaving Bangkok yesterday,tourist visa expired on 24 Feb and it was 25th. I was escorted behind the passport booths to a table where two serious Thais studied my passport and previous arrival/departure stamps. They stamped a new message,with the number 24 in amongst the text,I was was sent on my way. "No fine because less than 24 hour overstay" was all they said. No smiles,no looking up,I was waved away to continue my passage out.

Yes, I had almost exactly the same scenario about 2 years ago, although they were more convivial; But there was no stamp indicating 24 at all made in my passport.

It was a bit annoying as I knew there could be a "niggle" and so went to clear immigration the day before (0130 flight, so I went through at 2300), which would be within the date limits. However, they insisted that the scheduled flight time was the deciding factor, and not clearing immigration.

Yes I got an overstay once under the same circumstances. I think I was on the BA flight soon after midnight! I tried saying I was stamped out of the country prior to being on overstay and it also did not fly with them.

Well deserved too. A few days overstay would be acceptable due to miunderstanding, genuine mistake etc. , but nearly a year is inexcusable. It isn't exactly difficult to obtain a correct visa for Thailand!
